MARQUETTE COUNTY, Mich. (WLUC) - An on-going legal battle between the Marquette County Road Commission and the U.S Environmental Protection Agency may be headed to the U.S. Supreme Court.
The Marquette County Road Commission petitioned the Supreme Court on October 25th.
They want a review of their lawsuit with the EPA regarding County Road 595. In 2012, the EPA blocked construction of the road that would have created a more direct route for mining trucks to get from the Eagle Mine to the Humboldt Processing Mill.
The road commission filed a lawsuit instead of re-applying for a new permit. The lawsuit and following appeal were thrown out by the United States Court of Appeals.
The road commission is asking the Supreme Court to review the appeals court decision.
