EAGLE RIVER -- It was a mixed verdict in the trial of a Calumet man accused of fleeing the scene of a fatal drunk driving crash.
On Friday 39-year-old David Paul Simons was found not guilty of operating a vehicle under the influence of alcohol causing death.
But the jury did find him guilty of driving with a suspended license causing death and failure to stop at the scene of an accident causing death.
On November 5, 2011, Simons lost control of his vehicle on Five Mile Point Road in Keweenaw County and hit a line of trees.
His passenger, 54-year-old Jeffery Brusso, was killed in the crash. It took about three and a half hours for the jury to reach a verdict.
Both the prosecutor and defense attorney declined comment.
Simons will be sentenced in four weeks.
