MUNISING -- The defense attorney for the Canadian man accused of trying to kidnap a 12-year-old Munising girl is pushing to have the case dismissed.
Mohamed El Fectali allegedly confessed to the crime during a videotaped police interview. But Judge William Carmody granted a defense motion to suppress El Fectali's statements.
Wednesday, the defense made a motion to prevent the case from being bound over to circuit court for trial.
Alger County Prosecutor Karen Bahrman asked for a stay in the proceedings so she can appeal the judge's ruling to throw out the alleged confession. The defense says El Fectali was just asking the girl for directions and offered her a ride home.
El Fectali is charged with attempted kidnapping and enticing a child for immoral purposes.
