Legion members continue to fight smoking ban

Members of American Legion Post 444 are, once again, fighting the statewide smoking ban
BARAGA -- Refusing to stand defeated, American Legion Post 444 is reigniting the fight on Michigan's smoking ban.
Lighting up hasn't been allowed in the Baraga County Post since a judge issued an eight-page written decision ordering the post's compliance.
The post had requested the hearing to ask for continued smoking in its gaming area, making it similar to exempted Detroit casinos.
Now, members are taking further action to reverse the order.
"The post has asked for a ruling that they are exempt from the provisions of the Clean Indoor Air Act, I guess it's called," says Post 444 spokesman Joseph O'Leary. "They've asked for that declaratory ruling from Lansing. They did indicate they would issue a declaratory ruling so we're just waiting for that to happen."
No timetable has been set for a decision.
