Contested smoking ban court date set

HOUGHTON -- A court date has been set for the next step in the battle between the American Legion Post 444 and the Western U.P. Health Department.
    
The issue stems from the post suing the health department over Michigan's smoking ban.  They feel the ban is an unconstitutional infringement on their private property rights.
    
At a clarity hearing in October, the judge ruled that the post must comply with the law.
    
Now, the issue will be back in court on December 3 in Houghton County.
    
At that time, motions will be heard to determine if the case will be allowed to continue.
