John Ray had his preliminary examination Tuesday afternoon
IRON MOUNTAIN -- It has been close to a year since two brothers were seriously injured during a fight in Iron Mountain.
Twenty-two-year-old Robert Irish was sentenced to one year in jail for his part, and now a second man, 23-year-old John Ray, is also facing charges. Ray is charged with one count of assault to do great bodily harm less than murder.
Several different accounts of what actually happened that September night were given Tuesday afternoon during Ray’s preliminary examination in district court. Much of the testimony focused on who assaulted Mark Uren who was hospitalized with severe injuries including broken bones on his face and nose.
"I went running towards the street, and I don’t even remember making it to the street,” said Uren.
Two of the men involved in the fight also testified. Irish said the whole thing was fast and confusing.
“I didn’t see Ray hit him. I just saw Ray running from the direction of Mark Uren,” he said.
Nick Nelson also agreed to testify in exchange for immunity. He agreed with Irish but said he saw Ray kick Uren in the face.
“I heard a scream and Mike said, 'Call the cops,' and then I looked to my right and I see John kick Mark in the face,” Nelson said.
With the prosecution only having to prove probable cause, Judge Christopher Ninomiya determined there was enough evidence to bind the case over to circuit court.
Ray's arraignment is scheduled for September 13 in Dickinson County Circuit Court.
