Prisoner loses 1 of 5 teeth, sues state

MARQUETTE -- The lawsuit filed by an inmate against an Upper Peninsula prison has been pushed back to September.

Jerry Flanory filed the lawsuit, claiming that he was denied toothpaste while serving his prison sentence at the Baraga Maximum facility, and that lead to the removal of a tooth. The corrections department says Flanory only had five of his adult teeth remaining when he was incarcerated.

The case was to be tried on Monday; however, it has now been moved to September 17 in U.S. District Court in Marquette.
