Man accused in fatal drunk driving crash is headed to trial

CALUMET -- The Calumet man accused in a fatal drunk driving crash will have his case go to trial.

Last week there was talk of a plea agreement for 38-year-old David Paul Simons, but an agreement could not be reached.  A three-day trial is scheduled for mid-January.

"Your honor, I do not believe that we've reached an agreement in this matter," said Donna Jaaskelainen, prosecuting attorney for Keweenaw County. "We had scheduled, tentatively, a trial date of January 16, 17, and 18 of 2013 in this matter, and it looks like we're going to continue to trial, your honor."

Simons is charged with failing to stop at the scene of an accident while at fault, causing death, and operating a vehicle while intoxicated, along with a suspended or revoked license while causing death.
