ESCANABA -- In Delta County Circuit Court, the case of 27-year-old Douglas Duane Barbeau of Garden was heard Monday.  Barbeau's motion concerning evidence is in connection with a snowmobiling hit-and-run incident last January.

The defendant did not appear in court.  Barbeau is charged with assault with intent to do great bodily harm less than murder.

On January 28, Barbeau allegedly hit an ice fisherman with his snowmobile near Ansell's Point in Garden.  The ice fisherman was seriously injured.  The incident happened after an apparent altercation between the two men.

If convicted, Barbeau could face ten years in prison and another five years on the charge of failing to stop at the scene of an accident.

The prosecutor says he's still trying to contact the victim.

"It looks like you've given what you have, and what you don't have you'll give as soon as you get it, fair to say?" asked Delta County Circuit Court Judge, Stephen Davis.

Barbeau's next court appearance is scheduled for September 27.
