L'ANSE -- Two men accused of home invasion and attempted murder appeared in Baraga County Circuit Court Thursday.

Twenty-seven-year-old Daniel Nieskes and 32-year-old Douglas Garver are accused of breaking into a Baraga apartment, seriously injuring one of the residents and damaging property.

Nieskes is charged with home invasion and attempted murder.  He stood mute on all five counts, and the judge entered a not guilty plea on his behalf.

"The underlying offense is homicide murder in the first-degree, premeditated," said the judge. "And how, sir, do you wish to respond to count five?"

"Mute.  We ask the court to entertain the request to lift the daily p.b.t. requirement given," said the defense attorney.

Garver is charged with six different counts, including first-degree home invasion and attempted murder.  He previously served time in the Marquette County Jail for aggravated domestic violence.  If convicted, he faces up to life in prison.

Both men are scheduled to be back in court in March.
