Murdock's lawyer claims the death was purely accidental

MUNISING -- An Alger County man charged with involuntary manslaughter appeared in court Thursday in hopes of getting the charge dismissed.

Thomas Murdock is charged with the death of Lisa Hardwick when he ran over her with his vehicle last June.  Murdock is also charged with driving while intoxicated and possession of marijuana.

Murdock's attorney asked the judge to dismiss the involuntary manslaughter charge since the area where the incident took place was on private property and not publicly accessible.  The attorney maintained the death was purely accidental.

The judge ruled against Murdock's motion, but agreed to let the jury view the site to decide for themselves.  A trial date has not been set.
