Arraignment set for local teens charged with criminal sexual conduct

HOUGHTON -- The preliminary hearings wrapped up today in Houghton for two teens charged with criminal sexual conduct.

Witnesses took the stand today testifying about a night of drinking and partying gone wrong.

Benjamin Hyrkas of Lake Linden and Devin Angers of Mohawk are accused of having sex with a girl who was allegedly drunk and blacked out at the time the assault took place last February.

Angers is charged with two counts of criminal sexual conduct while Judge Janis Burgess dropped a gross indecency charge on Hyrkas, leaving him with one count of CSC.

“There was testimony that the prosecution presented early on from the victim which, if believed, would be sufficient to establish count one in each of these cases,” said Judge Burgess.

“I believe her testimony is sufficient to establish if she's believed that she was physically helpless," she added.

The men are expected to appear in Circuit Court for arraignment next week.
