The Michigan Court of Appeals upheld the conviction

MUNISING -- The Michigan Court of Appeals has denied the appeal of a former Citgo gas station employee in Munising convicted of stealing the night deposit.

Marlena Dee Nevarez told police she was robbed at gunpoint by a snowmobiler in January of 2009.

Investigators found several holes in her story.  She was later convicted of larceny and filing a false police report.

Investigators say Nevarez had a history of shortchanging the gas station by giving away merchandise or inaccurately ringing up sales.

Nevarez claimed evidence of those previous crimes was improperly admitted at trial, but the appeals court ruled there was plenty of other evidence to convict her.

She was sentenced to a year in jail and two years probation.
