Nancarrow files motion to dismiss embezzlement charges

MARQUETTE -- Attorney James Nancarrow was in Marquette District Court on Thursday filing a motion to quash information and dismiss the felony embezzlement charges against him.

The judge ruled against him.

Nancarrow is charged with embezzling over $50,000 from a trust account he was holding for a client.

Defense attorney Steven Polich argued that prosecutors did not have probable cause to charge Nancarrow because they didn't provide enough evidence at this preliminary hearing and that since the money was eventually paid from a different account, there was no criminal liability.

Judge Gotham ruled against the motion and conferred with counsel in chambers to set the date for the next hearing.
