HOUGHTON -- Criminal charges will not be filed against a driver involved in an accident last year that resulted in the death of a Laurium man.  That is according to the Houghton City Police Department.

The fatal accident happened on Bridge Street on November 29, 2010.

Sixty-one-year-old Gerald Hyrkas, a member of a survey crew, was killed, and a second man was hurt.

After a lengthy investigation, the Houghton City Police determined that this was not a criminal situation.

A civil infraction will be brought against the driver.  The police declined comment on what that infraction is.

The driver's name has never been released by the police, according to the department's policy on non-criminal cases.
