Terry Lee Langenberg waived preliminary exam
CRYSTAL FALLS -- Terry Lee Langenberg, age 55, waived his right to a hearing Monday morning in Iron County district court. The Iron County resident faces nineteen felony charges for alleged fraudulent business practices regarding his funeral home business and has pled not guilty. The nineteen new charges are on top of four misdemeanor charges of funeral contracts violations, for which Langenberg served 60 days in jail already.
District Court Judge C. Joseph Schwedler has bound Langenberg over to Circuit Court pending trial.
Langenberg, who is currently serving eighteen months probation for the previous charges, has also requested that he be allowed to fly to Chesapeake to visit his daughter over the holidays. He still owes nearly $40,000 in restitution to his victims, however, and was sentenced in August to an additional six months in jail for failure to pay.
The defense claimed that he will not be paying for the trip.
"The ticket is covered by his daughter," defense attorney Hank McRoberts told Schwedler during the proceedings. "I don't foresee Mr. Langenberg putting out significant funds toward his trip."
A decision will be made on the request later this week, though prosecuting attorney Melissa Powell-Weston opposed it. Both attorneys have declined comment with TV6 at this time because the case is still open.
Langenberg will be back in court again on January 5, 2009 at 9 a.m. central time for a pre-trial conference.
