Accused murderer takes the stand

CRYSTAL FALLS -- The jury sat through an all day examination of the defendant. David Levack began by saying he had no real motive to kill Joyce Johnson. Although he was scheduled to stand trial for stealing property from the victim, he was confident he would have come out an innocent man.

“I was going to go to court that next day, and I was going to prove my case by showing this. I would have been acquitted 100 percent,” says Levack.

Friends of the victim have previously testified that in the courtroom the morning Johnson’s body was discovered, Levack showed no emotion. Levack testified Thursday that he was instructed to do so by his attorney John Kivisaari. The attorney had said to show no reaction inside the courtroom.

“He told me, 'Don't show any reaction…don't show any emotion,'” Levack explains.

Levack testified that Johnson was like a grandmother. He helped Johnson bring her husband home and care for him while he suffered with dementia. Even after his passing, he continued to help her with chores around the house.

“I did not kill Joyce Johnson. I had nothing to do with it. I didn't want it done…I do not know who did this,” Levack says.

It was a long day for the jury, but at the end of the day, both the prosecution and defense came to rest. Court will reconvene Friday, and the jury will begin deliberating until a verdict is reached. If convicted, Levack faces life in prison.
