MARINETTE COUNTY -- The 55-year-old Crivitz man who allegedly killed his ex-girlfriend at a gas station in Wausaukee appeared in Marinette County Circuit Court on Thursday.

Police arrested Richard Heyer last summer for the murder of 51-year-old Ann Schueller. Heyer pled not guilty by reason of mental disease or defect last month.  After undergoing the evaluation, the result showed no mental defect.

"The court doctor who examined him thinks that he's responsible for his conduct," said Allen Brey, District Attorney. "The doctor examined him and it's the doctor's opinion that, no, the defense doesn't find that he's responsible for his conduct."

The judge is allowing the defense attorney to hire a physician to run another examination. Heyer is expected to appear in court on March 22 for a final motion hearing. His trial is scheduled for May.
