SAULT STE. MARIE -- A former Michigan State Police post commander will be back in court facing charges in Chippewa County.

William Smith had been the commander of the Gladstone Post when he was arrested.  The original case against him was dismissed when the judge ruled the warrant for a blood alcohol test was illegal.  However, the case is heading back to court.

Smith will be recharged this week for operating while intoxicated.  His arraignment in Chippewa County District Court is set for Friday at noon.

During the last case, a special prosecutor was brought in for the case.  At this time, the court could not confirm if a special prosecutor will be brought in.
