HOUGHTON -- The Calumet man accused of a fatal drunk driving crash was in Houghton County court on Wednesday.
David Simons stood mute on all three felony counts and the judge entered a not guilty plea on his behalf. According to police, Simons lost control of his vehicle last November and hit a tree, killing his passenger, Jeffery Brusso. Simons, 39, is charged with operating a vehicle while intoxicated and operating a vehicle with a suspended or revoked license while causing death.
He's also charged with failing to stop at a scene of an accident while at fault causing death.
If convicted, Simons could face up to 45 years in prison. His three day trial is set to begin on November 6.
