Law enforcement officials first interview with Levack and what was said
CRYSTAL FALLS -- Ken Walker, a Michigan State Police special investigator, was the center of questioning in court. Walker testified that Levack not only delayed the initial interview but was inconsistent with his responses. He went on to say that he thought it was suspicious that Levack had made his own assumption to Johnson’s time of death, while investigators still found it too early to narrow down.
“In my opinion it's a powerful statement that he said which supposedly is when that did happen...I think it's one of many comments in this interview that's problematic,” says Walker.
Defense attorney Dan Jaspen argued that his client had been unfairly treated. He said Levack is diabetic and was not allowed to eat until an hour through the interview. Jaspen continued saying this could have contributed to his client’s inconsistency.
Levack's mother, Doreen Chastyn, also took the stand. She says her son has never shown any signs of aggression.
"Even with his brother, never had a fight. Never fought. I've never seen him in a fist fight,” says Chastyn.
The prosecutor continued to question Chastyn as to why her son called her eight times the night before Johnson’s body was found. Chastyn responded that she can't recall everything but knows they spoke about Levack’s father, who was sick at the time. She also knows they spoke about her son's stolen property trial with Joyce Johnson that was supposed to take place the following morning.
After a long week of witnesses, the prosecution is expected to rest its case Tuesday morning, and then it'll be the defense's turn to start presenting its side of the case.
