MARQUETTE COUNTY -- It has been nearly four months since a Marquette County judge dismissed a case of child neglect against two Skandia parents regarding their 10-year-old son's cancer treatment.

Ken and Erin Stieler received national attention for their refusal to continue conventional cancer treatment for their son Jacob, who has battled Ewing Sarcoma.

After being struck down twice by a circuit judge, the attorney representing the Department of Human Services has filed for an appeal with the state Court of Appeals.  The Stielers' attorneys are expected to respond to the appeal this week, which they're confident will be rejected.

If the appeal is rejected, the case could go to the state Supreme Court.

The Stielers say Jacob has continued with routine PET scans which, in January, have shown no sign of cancer.
