Man charged with fleeing fatal crash in court

HOUGHTON -- A 38-year-old Calumet man, accused of fleeing the scene of a fatal crash, was in Keweenaw County Circuit Court on Monday.

David Paul Simons is charged with operating a vehicle while intoxicated causing death, operating a vehicle without a license causing death, and failing to stop at the scene of a fatal accident.

On Monday, the prosecutor told the judge there was additional information that needed review.

"We need to be able to have the opportunity to review these reports and the photographs," said Pam Dobbs, defense attorney.  "I understand that there are two different phone conversations that are also on DVD or CDs that we will be receiving.  We need the opportunity to review those and come to about what our next step needs to be."

Last November, police say Simons lost control of his vehicle while making a sharp turn and his 53-year-old passenger, Jeffrey Brusso, was killed in the crash.

Simons is scheduled to be back in court for another pretrial in one month.
