MUNISING -- A judge sentenced a Trenary man on Monday for up to 90 days in jail for operating a snowmobile while impaired.

The state originally charged 26-year-old Nathan Curry with driving while intoxicated and causing serious injury.  He hit and ran over Kyriea Schultz with his snowmobile in February 2010.  She suffered a punctured lung, as well as rib, back and liver injuries.

Curry's attorney tried to argue jail time was a severe punishment for a first offense, but the judge failed to be persuaded.

"You came to the court, Mr. Curry, without a record of consequence, and that bodes well for you here," said Judge William Carmody.  "But like I said, but for the Grace of God, this situation wasn't any worse than it was."

Curry declined to make a statement to the court due to a pending civil case against him regarding the incident.
