Quarry quandary goes to federal court

PORTAGE TOWNSHIP -- When the owners of the Valley View Quarry were ordered by a Houghton County Circuit Court ruling to cease operations, they made it clear they would appeal the decision.

Now the Moyle Company has filed a lawsuit against Portage Township in U.S. District Court.
    
According to Moyle's lawyer, Daniel Dalton, the lawsuit is an issue of fairness.
    
The official complaint alleges the court decision resulted in the taking of their property that the township reneged on a prior agreement to allow the quarry to stay and that the zoning ordinance has not been enforced on other companies.
    
Tuesday, Moyle's attorney also filed a preliminary injunction asking that operations are allowed to resume while the lawsuit is pending.
