Landowners blocked the corridor which served as a popular biking and walking path between Houghton and Chassell.
PORTAGE TWP. -- The Michigan Court of Appeals has upheld a 2008 decision giving the state rights to a rail-trail in Houghton County.
In 2005, nearby land owners blocked the corridor which served as a popular biking and walking path between Houghton and Chassell. The owners were ordered to remove the barricades, but refused claiming it was part of their private property.
The State of Michigan then brought on a court case against the land owners. The court ruled that the state does, indeed, have the land rights to the railroad corridor.
The owners using the barricades appealed the ruling.
The DNR announced Wednesday that the Court of Appeals has upheld the ruling giving rights to the state late last week.
One of the land owners has told us that they are considering an appeal.
