Parents can sue over boy's harassment at school.

HUDSON, MICHIGAN (AP) -- An appeals court has given new life to a lawsuit that claims a Michigan school district didn't do enough to stop the harassment and humiliation of a student.

The boy's parents can continue to press allegations that Hudson Area Schools was "deliberately indifferent" to years of abuse inflicted by other kids.

A federal judge had ruled in favor of the district near the Michigan-Ohio border and dismissed the case in 2007.  But the appeals court said Tuesday there are issues that should be considered by a jury.

The boy was harassed beginning in sixth grade.  By ninth grade, he was sexually assaulted.

The Hudson district says it punished and even expelled students each time they could be identified.
