Evidence stands in marijuana case

IRON MOUNTAIN -- A Norway man facing possession charges was denied a motion to suppression of evidence in district court earlier Monday.

State Police went to 36-year-old Christopher Charles Bennett’s home in March for a bench warrant on an unrelated charge. Officers smelled marijuana from the outside of the residence and entered without a search warrant where they discovered 96 marijuana plants.

Bennett’s lawyer claims the illegal entry should exclude the evidence discovered, but Judge Celello denied the motion.

Bennett is being charged with one count of delivery/manufacture of a controlled substance, five to 45 kilograms of marijuana, a felony punishable by seven years and/or $500,000; possession of analogues, a felony punishable by two years and/or $2,000; and possession of marijuana, a misdemeanor, punishable by one year and/or $2,000.

He is scheduled for a pretrial on September 10 at 10 a.m.
