Man in court in relation to fatal crash

KEWEENAW COUNTY -- David Paul Simons, 38,  was back in Keweenaw County District Court Thursday on charges of failing to stop at the scene of an accident and operating a vehicle while intoxicated.

Simons allegedly lost control of his vehicle and hit a tree causing the death of his 53-year-old passenger, Jeffery Brusso.

During Simons' preliminary examination, three witnesses took the stand. One of the witnesses, Emily Peasy, is a bartender at The Cliff View Bar in Mohawk, and she says Simons and Brusso were speeding towards the bar before they came inside.

"If you're heading north, right before the Cliff View, there's a little cliff area," said Peasy.  "There are some bushes, and they slid off into the gravel and then whipped back out and then came into the parking lot."

Peasy said she served Simons and Brusso alcohol the night of the accident.  The preliminary examination for Simons will continue on July 26.
