Home invasion suspect bound over to circuit court

MARQUETTE -- The man who was shot while breaking into a Marquette home appeared in court Monday.

Jesse Homa allegedly entered a mobile home early in the morning of May 22.  Homa, whose legal residence is in Sayner, Wisconsin, is charged with first degree home invasion.  When Homa knocked down the back door of the home in question, the owner shot him twice in the leg with a pistol.

"I didn't wanna kill him," said homeowner Roger Atherton.  "I intentionally aimed low.  He turned and ran.  I was instinctively raising up toward center mass.  If he would've kept coming, heaven forbid."

Homa was bound over to circuit court and faces a maximum penalty of 20 years in prison and a $5,000 fine.
