FLORENCE -- The Iron Mountain man accused of assaulting a Wisconsin bar employee made his initial appearance in Florence County Circuit Court Tuesday morning.

Twenty-six-year-old Justin James Murphy was charged with one felony count of substantial battery with the intent to do great bodily harm after he allegedly attacked a 50-year-old employee of the C & R Bar in Aurora, Wisconsin last month.

Murphy has been released on bond since his arrest.

"We'll set this matter for a preliminary hearing.  It does appear at this point the bond is a $1000 signature bond with no contact provisions and not to enter the C & R Bar," said the Honorable Judge Leon Stenz.

The bar employee was treated for a head injury at the Dickinson County Hospital and has since been released.

Murphy will be back in court for a preliminary hearing on May 19.

It sounds to me like your angry your friend is in trouble and it makes you even more angry that you cannot come up with a more legitimate argument in his defense than calling me a know it all. If any of my previous statements are untrue, I invite you to point them out.

You sound to me that you are a mr no it all, you've done it all been every where, so there is no telling you how things happen. So this is my last response to you, cause your always right and nobody else knows what is goning on in the world besides you. So ok what ever you said happened is what happened then, maybe you should go to court with them and explain to the judge just went on that night, in case someone has a question that no one knows the answer too.

Ok, he didn't start the fight, he was getting escorted out of the establishment because he tried helping a little ol' lady across the street. C'mon...Really? The guy was obviously being obnoxious enough to get escorted out of the bar. Really, are you that naive and undereducated to think that because someone is a bouncer that somehow entitles you to take a swing at them when you see fit? That doesn't even make sense. The bouncer has the same rights to press charges as any other person in the public. I don't know Justin, he may be a cool guy, but fighting is illegal so unless he was defending himself, he broke the law. I just have a hard time believing that he was sitting there, minding his own business and a bouncer came up and tried to remove him from the bar for doing nothing and did so in such a violent fashion that he had no other alternative but to strike the bouncer. It doesn't add up.

So what your telling me that every man in the world is a out of control jerk. I'm sure that almost every man has gotten into a fight at some point, so all of them are out of control jerks. I'm not here to argue with you about who is right or wrong when it comes to fighting, but if were gona press charges against one person for fighting i think we should press charges on everyone that gets into a fight. Just because someone hits a bouncer and he gets his pride hurt, doesn't mean he should be the one that gets charged with intent to do bodily harm, cause the last time i seen a fight it sure looked like to me that they all seem to think they were gona do bodily harm to the other person before they got it done to them.

So hitting people make you a man? Not really it makes you an out of control jerk. As for filing charges, when the police are called and there is a personal injury resulting from a fight. The police are the ones filing charges. There are things called laws and it just so happens it's against the law to fight. Fighting doesn't show anyone you are a man and any real man would know that.

I've known Justin for about 11 years now, i have worked with him in the past, and i know he would not go out looking for a fight. What makes you people think that he is the one that started the fight, did you ever think that someone else might of started the fight with him and he was just protecting himself, and then the bouncer came up and got knocked on his butt, and thats why justin is getting charged. If he had not been a bouncer no charges would have been made. I dont see any charges against any of the other people that were fighting that night. I think if your going to be a bouncer at a job, just like every other job, things happen, deal with it, be a man and not a baby and don't go pressing charges against every one that trys to hit you when you try to escort them out.

Hey Joe your right on, it doesn't matter what someone says to you or how much they make you want to beat on them. You can't hit people, violance is wrong and not the answer. As for the comment someone made about the over aged bouncer, that is just ludicrous, it wouldn't matter if he was 21 or 60 it is still against the law to hit someone for doing their job. If you can't control your emotions and have to get violant, well then you need help. Everyone should be able to go and have a good time without somebody trying to show what a big man he is, because all it does is make everyone see what a punk you are when you get violant. Jail and anger managment classes might help.

This is a great example of why this country is going down the tubes. The dude went to a bar, got plowed, got into a fight and got himself in trouble. Everyone tries to place blame everywhere but on the person comitting the illegal act. He's a big boy, he made a choice and now has to deal with the consequences. He was drunk... who cares. No one forced him to drink. He made all the choices for himself that night and he is responsible for what he did. Not the bar, not the bouncer. I can think of many people, on a daily basis, that I would love to pop for various reasons. But I don't even if I happen to drink a lot of booze. Why? Because I am a human with free will and know to consider the consequences of what I do. People like this need to step up, admit what they've done, take the consequences and move on. Making excuses does no one any good. Also, consider all the law abiding citizens who attend the bar, have fun, and break no laws. Should they be punished and miss out because this dude can't hold his liquor?

I heard there was more then one person in this fight, so why wasn't any body else charged. The only reason is that justin hit the over aged bouncer and knocked him on his butt, and thats why he is getting charged. I think if the bouncer can't do his job then maybe he should look for something else. And as for doing bodily harm, well it would be the first fight i ever heard or seen that the other person doesn't have that in mind when fighting. Think about it, everyone that was involved in that fight, was planning on doing bodily harm to the person they were fighting with.
I think that Justin should turn around and sue the bar for giving him to much to drink, which lead him to get into a fight in the first place and knock the over aged bouncer on his butt.
If it wasn't for knocking the bouncer on his butt, he would never have been charged with anything.
And i agree with who ever wrote that this is a bad place to go to, i think that they should really consider shutting that place down. Thats all you ever hear about is someone getting in a fight there, it was happening when i use to go there and it is still happening. Shut it down.

What are you talking about? The bar employee wasn't to drunk to stand or even drunk. He was doing his job escorting an unruly customer that was causing problems out of the bar. Of course he couldn't stand up after the trouble maker knocked him unconscious. It is not ok to use violence, it's is illegal to beat and or kill people. It's not illegal to drink and have a good time and as for drunk driving, well that's against the law also. There is a thing called a designated drive or a taxi cab. So take a chill pill and don't try to condone this guy’s violence.

Slow newsday???

The use of the word "employee" is a mistatement. A person who allegedly gets paid in drinks, gets intoxicated on the "job" is probably not the definition of an employee. How is that reported on his W-2??? This institution has a well earned reputation for rowdiness both inside of the establishment as well as outside. As a taxpayer in Florence I am fed up with the irresponsibility of the bartenders, bouncers, and owners of places serving alcohol in Florence that act irresponsible. I know there will be those that feel it is not the reponsibility of the bar to "cut someone off" or they will state that they do act responsible. I could name a incident involving a patron leaving a bar, getting arrested, or in a accident for nearly every bar in Florence Co. Perhaps if a bar where to be fined for overserving patrons, there would be less alcohol related incidents. My taxpayer dollars are being used to convict drunk drivers, investigate drunk driving deaths, alcohol related assaults, etc. Maybe shutting down a place for a weekend would send a message. There is no reason things should get so far out of hand, no one should be helped out to their car because they are too drunk to walk, and certainly bar employee's should not be intoxicated while working. This is my opinion and it is probably obvious I do not drink, but I do drive my car on the roadways and I do pay taxes. I have every right to be angry, and I don't feel anyone has the right to be intoxicated and use the roadways. If you want your tax dollars spent convicting people of alcohol and drug related offenses instead of alcohol and drug prevention than don't be upset when there isn't a police officer around when you need them. They'll be cut back because of time spent in court, investigating alchohol related crimes, and prosecuting ridiculous cases such as this. A bouncer too drunk to stand up! If TV6 wants a real investigative story, how about the number of incidences relating to alcohol in Florence, the cost to taxpayers to convict someone of OUI, the cost to convict someone of OUI causing death and the man hours spent on such needless crimes. That would be a news story!
